ADR (California)

Alternative Dispute Resolution as specifically applied under California Davis-Stirling Act. California Civil Code Section 5925 et seq. encourages the use of ADR, including mediation and arbitration, to resolve disputes between HOAs and their members. Before filing certain types of lawsuits, parties must offer to participate in ADR. If the prevailing party in litigation had previously refused an ADR offer, the court may consider that refusal when awarding attorney fees.
