AB 3182

A California law effective January 2021 that restricts HOA ability to impose rental restrictions in common interest developments. Under AB 3182, an HOA cannot prohibit rentals altogether and must allow at least 25% of units to be rented at any time. The law also voids any requirement for HOA approval of tenants beyond confirming that occupancy limits are met. This law was enacted to address the housing shortage by increasing rental housing availability.
